Licensing & form-use requirements
Last updated: June 17, 2026
Why this page exists
Every form on Xpressforms.ai is governed by a regulator or association that defines who may fill, sign, and distribute it. Using a form without the appropriate license and membership can constitute the unauthorized practice of real estate, copyright infringement, or both. This page is the authoritative source for what each library requires.
Form library requirements
| Library | Required license | Required membership |
|---|---|---|
| TREC promulgated (residential resale, new home, condo, farm & ranch, addenda) | Active TREC Sales Agent or Broker, sponsored or sponsoring | None required |
| TAR residential (listing agreements, BBAs, residential lease, RPN, seller's disclosure) | Active TREC license | Active Texas REALTORS® membership in good standing |
| Local association forms (HAR, ABoR, NTREIS, SABOR, etc.) | Active TREC license | Active membership in the issuing local board |
| TAR commercial (commercial contracts, commercial lease, letters of intent) | Active TREC license | Active TAR membership + commercial form authorization |
| Property management addenda (where applicable) | Active TREC Broker license or sponsored agent acting under a broker | Active TAR membership |
We attach a license & membership badge to every transaction record at the time of execution. If your status lapses, the affected libraries are hidden from your account and any in-flight drafts are paused until your status is restored.
What we verify and when
- At onboarding: TREC license number, sponsoring broker, TAR / local board ID, and email domain.
- Continuously: we re-check TREC and association status on a rolling basis and on every form open.
- At signing: the audit trail records the licensee's license number, broker, and association membership at the moment of execution.
Broker oversight
Sponsoring brokers receive a read-only oversight account at no charge. The oversight account shows every transaction created by sponsored agents, the forms attached, the status of each form, and the audit trail for every signature. Brokers can revoke an agent's access instantly from the broker console.
Unauthorized practice of law (UPL)
Xpressforms does not draft custom contractual language for you and does not provide legal advice. The Service enforces TREC §537.11 by limiting edits in TREC-promulgated forms to factual blanks and approved addenda. Custom language outside the promulgated blanks must be prepared by a Texas-licensed attorney representing a principal to the transaction.
Electronic signatures & audit trail
Every executed document includes a tamper-evident audit trail that captures signer name, email, IP address, timestamp (UTC and Central), authentication method, and a SHA-256 hash of the final PDF. Audit trails comply with the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act (Tex. Bus. & Com. Code Ch. 322).
Data security & record retention
- TLS 1.2+ in transit; AES-256 at rest.
- Role-based access control; broker oversight isolated from peer agents.
- Documents and audit trails retained for a minimum of four years from the closing date or last contact, per TREC rules.
- Annual penetration test; SOC 2 Type II program in progress.
